“We the people of the United States…” Although the preamble of our constitution was written in English, the United States does not recognize an official language.

One thing we do have outlining accepted customs and ordaining other miscellaneous organizations is the U.S. Code.

One such outlined practice can be found in 36 U.S. Code § 301 a, stating “The composition consisting of the words and music known as the Star-Spangled Banner is the national anthem.”

It goes on in the first half of section b to talk about the conduct armed forces and former armed forces are to take when the national anthem is played. Finally it states the practice for civilians. “all other persons present should face the flag and stand at attention with their right hand over the heart, and men not in uniform, if applicable, should remove their headdress with their right hand and hold it at the left shoulder, the hand being over the heart”

The auxiliary verb is “should”. Should being used as a suggestion to take part. If should was changed to shall then it would require action. It would state strongly that you will stand.

What does this mean for you? This means that as much as some citizens or military may not like NFL players such as Colin Kaepernick kneeling during the national anthem he is clearly in his right protected under the first amendments freedom of speech.

As for myself, I “shall” follow this suggestion and I believe you “should” do the same.
